West Virginia Mugshot Social Rules

West Virginia Code §62-1-6a limits social-media posting by covered law-enforcement agencies for booking photos tied to a defined minor offense. The law also requires a covered agency to remove a posted photo within 14 days after a subject or representative requests removal following specified favorable outcomes. DCR and its subordinate organizations are excluded from the section’s definition of covered agency. Therefore, §62-1-6a does not settle every WVDCR photo-access question. Eligible multiple misdemeanors use two years, while an eligible nonviolent felony uses five years. Many offenses are excluded, and the court must grant relief. Once an expungement order applies, agencies must follow its terms and certify action as the statute requires. The signed order, not a commercial summary, is the correct document to send with a removal request.

For a nonconviction matter, §61-11-25 supplies a separate petition route with its own conditions. The Calhoun clerk can provide the filed order when public access allows. A docket label alone may not show which records or images the order reaches.
